What is DPVAT Insurance

DPVAT Insurance is the MANDATORY INSURANCE FOR PERSONAL DAMAGE CAUSED BY MOTOR VEHICLES ON LAND TRAFFIC, BY THEIR LOAD TO PERSONS TRANSPORTED OR NOT.

Created in Law No. 6,194/74, amended by Laws 8,441/91, 11,482/07 and 11,945/09, with the purpose of helping and supporting people who are victims of traffic accidents, whether or not they are to blame for the accident.

WHO CAN BE COMPENSATED BY DPVAT INSURANCE

Anyone involved in any type of traffic accident, whether driver, passenger or pedestrian. In the event of death, your heirs (beneficiaries) may request the DPVAT insurance compensation.

Compensation is paid individually, regardless of how many victims suffered the accident, even without knowing who is to blame, this will not imply anything, even if the vehicle is not identified, as long as it has a Police Report (BO).

WHAT DPVAT INSURANCE COVERS

O DPVAT insurance serves even for reimbursement of private medical and hospital expenses. In case of death, total or even partial permanent disability.

HOW TO REQUEST COMPENSATION

To request your compensation there are some simple ways, today even in CEF (Caixa Econômica Federal) the DPVAT insurance service. Since 01/2021.

Insurance can be requested via the DPVAT CAIXA App, available on your Play Store (Android) or Apple store (IOS).

It can also be done at any Caixa Econômica Federal branch. Remembering that Caixa only makes compensation claims for accidents that occurred from 01/01/2021.

To do this, simply go to the Application and look for the “Track my request” and carry out the procedures requested on the App, if you can't do it via the App, just go to the branch where you placed the order and check the status of your request.

WHAT DOCUMENTS ARE REQUIRED

to apply for DPVAT insurance compensation, if you are going to make the request at the Caixa Econômica Federal branch, the applicant must be in possession of their personal documents, in a simple copy:

In case of death

Copy of the victim's and beneficiaries' personal documents, which may be any of the following: Identity card, birth certificate, marriage certificate or work card (new model), CNH (National Driving License), CPF (Individual Person Registration) .

Proof of residence of beneficiaries.

Record of the occurrence issued by the police authority (Occurrence Report BO)

Victim's death certificate.

IN CASE OF PERMANENT DISABILITY

Copy of the victim's personal documents, any of the documents such as: Identity card, birth certificate, marriage certificate or work card (new model), CNH and CPF;

Proof of residence of the beneficiary;

Record of the occurrence issued by the police authority (Occurrence Report BO)

Report from the IML (Instituto Medico Legal) from where the accident occurred, informing the extent of the victim's physical or mental injuries, and their state of permanent disability.

Hospital or outpatient medical care report, of the first medical care after the accident, with indications of the procedures adopted.

Treatment report, indicating the injuries caused by the trauma, with the date and location of the treatment carried out, including clinical, surgical, physiotherapeutic and examinations, and also the date of completion of the treatment, with an indication of definitive or permanent sequelae.

If you need other documents, the fund will request it from the beneficiary, depending on the degree of injury caused in the accident.

IN CASE OF MEDICAL EXPENSES

Copy of the personal documents of the person involved, which could be any of the following: Identity card, birth certificate, marriage certificate or work card (new model), documents such as CNH and CPF is essential;

Copy of the beneficiaries’ proof of residence;

Occurrence record issued by the police authority (Occurrence Report BO)

Medical-hospital care report, or equivalent document that proves that the medical-hospital expenses incurred occurred due to the care provided to the victim of the accident described in the Occurrence Report (Occurrence Report)

Report of the injury and examinations performed (If any)

Proof of expenses (receipts and invoices), detailing medical fees and medical expenses (such as materials and medicines), accompanied by medical orders and prescriptions.

HOW MUCH AMOUNT CAN YOU RECEIVE

Everything depends on the degree of damage caused by the accident, the compensation for death is R$ 13,500.00, in accordance with Law No. 6,194/74, and will be paid into a digital social savings account, opened in the name of the legal beneficiaries.

It is worth remembering that the deadline for claiming compensation is 3 years from the date of death.

In the event of death, the beneficiaries who will have right to DPVAT insurance are the spouse, partner or legal heir of the victim, according to article 792 of Law 10.406/02 (Civil Code).

PERMANENT DISABILITY

In case of permanent disability, even if the treatment has been completed or the disability is definitive, based on the percentage of disability, the value will be verified in accordance with the table of compensation values for bodily injuries, in accordance with Law no. 6,194/74.


Compensation corresponds to the value of R$13,500.00, in accordance with Law No. 6,194/74, and is paid into a digital social savings account opened in the victim's own name.

Remembering that the deadline for claiming compensation is 3 years from the date of the accident, and in case of permanent disability, the victim must make the claim themselves.

In the case of reimbursement of hospital medical expenses, if everything is duly proven by the victim himself, the reimbursement amount is up to R$ 2,700.00, in accordance with Law No. 6,194/74, and will be reimbursed in the name of the victim in a social savings account digital. The deadline for making a reimbursement request is up to 3 years from the accident.
